On May 11 2020, The Danish Maritime and Commercial High Court decided that a series of information in an August 2018-decision from the Danish Competition Council on the subject of Teller’s (now Nets A/S) abuse of a dominant position are not exempt from publication. Thus, the Danish Maritime and Commercial High Court has ruled against Nets A/S that made a claim for exemption, i.a. on the identity of customers affected by the abuse of dominance and the illegal customer contract terms in question.

On 2 March 2020, the Maritime and Commercial Court has confirmed that it was illegal, when CD Pharma (a pharmaceutical distributor) abused its dominant position by increasing the price on Syntocinon from EUR 6 to a high level of EUR 127 corresponding to a price increase of 2,000 pct. The Competition Council first adopted a decision in the case in 2018.

The High Court of Western Denmark has confirmed that the Danish Competition and Consumer Authority acted correctly in connection with the notification of the merger between Dansk Supermarked A/S (now Salling Group) and Wupti.com A/S in the summer of 2015.

The High Court has fined the construction companies Jorton A/S and H. Skjøde Knudsen A/S respectively DKK 3,000,000 (€ 401,442) and DKK 267,628 (€ XXX) for bid rigging. Two members of the managements were fined respectively DKK 75,000 (€ 10,036) and DKK 50,000 (€ 6,690).
20. December 2019
The City Court of Copenhagen has imposed a fine of DKK 30 million to the ambulance service company Falck Danmark A/S for abuse of dominant position. Falck abused its dominant position by excluding its competitor BIOS from ambulance services in the Region of Southern Denmark.

The High Court sentenced the Danish distributor of hair products Icon Hairspa A/S for resale price maintenance. Icon Hairspa A/S de-manded that the company’s dealers followed the recommended retail price as minimum price when selling “Kevin Murphy” hair products.
27. November 2019
The Danish Supreme Court has decided that the two undertakings LKF Vejmarkering (now GVCO) and Eurostar Danmark infringed the Danish competition Act, by submitting joint bids for a project for the Danish Road Directorate in 2014.
07. November 2019
The High Court has fined the demolition company CMP Nedrivning ApS DKK 5 million and two members of the company’s management each DKK 125,000. The company exchanged prices with competing demolition companies. Thus, the High Court upholds the ruling at the City Court of Hillerød.

The Danish Competition Appeals Tribunal has upheld the decision by the Danish Competition Council stating that Clear Channel Danmark A/S and AFA JCDecaux A/S agreed to fix discounts in violation of the Danish Competition Act. The two companies are competitors and both sell outdoor advertisement space. The Competition Council will now refer the case to the State Prosecutor for Serious Economic and International Crime.
