Denmark: Distributor of hair products sentenced to pay a fine of DKK 1,000,000 for resale price maintenance

On February 15, 2019, The City Court of Næstved sentenced the company Icon Hairspa (a Danish distributor of hair products) to pay a fine of DKK 1,000,000 (€ 134,000) for resale price maintenance. A person from the management was sentenced to pay a fine of DKK 100,000 (€13,400).

For a period of one year, starting in 2016, Icon Hairspa demanded that the company’s dealers followed the recommended retail prices as minimum prices when selling the hair products.  

The case started in 2016 with a complaint to the Danish Competition and Consumer Authority from one of the dealers of the hair products. The complaint gave reason to believe that the prohibition against resale price maintenance had been violated. The case was therefore referred to the State Prosecutor for Serious Economic and International Crime who investigated the case and raised charges.
