Anti-competitive agreement/decision in an association of camera distributors

03. January 2019

The Danish Competition Appeal Tribunal has upheld a decision taken by the Danish Competition Council (DCC) that a horizontal cooperation agreement/decision among more than 50 independent camera distributors, who are members of an association of camera distributors called Team DS, constituted an infringement of section 6 of the Danish Competition Act and Article 101 of the Treaty on the Functioning of the European Union (TFEU).

Team DS had coordinated prices and exchanged information about its members prices and other competitive parameters on a market for retail sale of cameras and accessories hereto contrary to the prohibition of anticompetitive agreements in section 6 of the Danish Competition Act and TFEU Article 101. Consequently the DCC has ordered Team DS to stop the infringement and refrain from similar anti-competitive behavior in the future. The DCC has reported the association to the police.
