Gå til Godik has abused its dominant position on the Danish market for rental of portable toilets to events by applying a standard exclusivity obligation to customers on long-term rental agreements

30. April 2020

On 29 April 2020, the Danish Competition Council (“the DCC”) adopted a decision concerning Godik’s (a supplier renting out equipment to events) abuse of dominant position by applying a formal standard exclusivity obligation to customers renting portable toilets on long-term rental agreements. The DCC has found that Godik abused its dominant position between 2014 and 2018. Consequently, the DCC has ordered Godik to cease the illegal conduct.

On 4 December 2019, the association of Danish campsites, DK-Camp, accepted to pay a fine of DKK 300,000 (€ 40,149) for infringement of the Danish Competition Act.

On 21 December 2018 the Danish Competition and Consumer Authority (hereinafter “DCCA”) received a complete notification of the merger between SE a.m.b.a. (hereinafter “SE”) and Eniig a.m.b.a. (hereinafter “Eniig”). The merger was approved subject to remedies on 25 June 2019.

On 7 September 2018 the Danish Competition and Consumer Authority (hereinafter “DCCA”) received a complete notification of Royal Unibrew A/S’ (hereinafter “Royal Unibrew”) acquisition of sole control of Bev.Con ApS which owns 100 pct. of the shares in Cult A/S (hereinafter together referred to as “CULT”).

On the 30th of January 2019 the Danish Competition Council (”DCC”) ruled in a case concerning Falck’s (Denmark's largest provider of ambulance services) abuse of dominant position by deciding and implementing an exclusionary strategy which aimed at excluding Falck’s competitor BIOS from the market.

The two competing media owners Clear Channel Danmark A/S and AFA JCDecaux A/S, who both sell advertising space in outdoor-media, agreed to common discounts in violation of the Danish Competition Act.

On the 29th of August 2018 the Danish Competition Council (“DCC”) ruled in a case concerning Teller’s (a merchant acquirer) abuse of dominant position by use of rebates conditional on exclusivity and provisions regarding exclusivity. Teller’s agreements with some of the company’s largest customers contained provisions which had a loyalty enhancing effect and could foreclose competitors’ access to the market.
