Plumbing company pays fine in settlement for bid rigging

On July 20, 2017, the Danish plumbing company Fredensborg VVS-Teknik A/S entered into a settlement with the Danish State Prosecutor for Serious Economic and International Crime for infringing section 6 of the Danish Competition Act.

The infringement concerned 5 cases of bid rigging in the Copenhagen area in which the company exchanged information on prices and other terms and coordinated prices with one of its competitors. 

The infringement took place in the period from April 2012 until August 2013. 

Accordingly Fredensborg VVS-Teknik A/S accepted to pay a fine of DKK 1 million (€ 133.333). 

The amount of the fine was determined on the basis of the fact that Fredensborg VVS-Teknik A/S agreed to enter into a settlement. Furthermore the company’s ability to pay was taken into account as was the fact that 3 of the 5 cases of bid rigging were conducted before the increased fine level in the Danish Competition Act entered into force in March 2013. Moreover the size of the fine was determined on the basis of the gravity and the duration of the infringement and the company’s turnover. 

The Danish Competition and Consumer Authority started an investigation into the case on the basis of a tip back in 2015 and later on the Danish Competition Council decided to hand over the case to the State Prosecutor for Serious Economic and International Crime to undergo criminal proceedings. 

The case against the competitor is not yet closed.
