Danish Complaint System

If an economic operator has legal standing a complaint can be brought before the Complaints Board for Public Procurement (Complaints Board). The Complaints Board can pass legally binding decisions and award damages for losses incurred by the economic operator.

Complaints are subject to a fee of 20.000 DKK. If the Complaints Board finds in favor of the complainant, the fee is repaid.  

The Complaints Board provides guidance on the formal requirements for filing a complaint with the Complaints Board.

The Danish Competition and Consumer Authority (DCCA) can in exceptional cases provide guidance on the interpretation of the public procurement rules. For the DCCA to provide such guidance, it is required that the case raises questions of principal importance to the interpretation of the public procurement rules.

The DCCA only has the authority to express its opinion on the matter in question or to give recommendations to the relevant contracting authority. The DCCA does not have the competence to pass legally binding decisions. If the contract already has been entered into, the contracting authority no longer has the possibility to correct errors made in the procurement procedure.
